1. Introduction
These Terms of Service (hereinafter referred to as the "Agreement") govern the relationship between IE NAUMOV ALEXEY DMITRIEVICH (TIN 772485982884, OGRNIP 317774600350740), hereinafter "Administration", and the user of the Cloud Fitness service (hereinafter "User").
By using the Cloud Fitness service, available through the website cloudfitness.io, Telegram Mini App and the Messenger, the User agrees to the terms of this Agreement.
If you do not agree with the terms, please do not use our service.
2. Definitions
Service — the web and mobile application Cloud Fitness, including all features, tools, and content.
User — an individual using the Service.
Account — the User's account in the Service, created upon authorization through Telegram.
AI Coach — an artificial intelligence feature for creating workout programs and analyzing nutrition.
Subscription — paid access to extended Service features.
3. Acceptance of Terms
By registering and using the Service, the User confirms that:
• Has reached the age of 18 or obtained parental/guardian consent
• Has fully read and understood this Agreement
• Accepts all terms without any limitations
• Undertakes to comply with the Service usage rules
4. License to Use
The Administration grants the User a non-exclusive, non-transferable, limited license to use the Service for personal non-commercial purposes.
Prohibited:
• Copy, modify, or distribute Service content
• Use automated systems (bots, scripts) to access the Service
• Perform reverse engineering or decompilation
• Use the Service for commercial purposes without written permission
• Violate the Administration's intellectual property rights
5. User Account
Access to some Service features requires creating an Account. The User undertakes to:
• Provide accurate information
• Maintain the security of their Account
• Immediately notify of unauthorized access
• Be responsible for all actions performed through their Account
6. Subscription and Payments
6.1. Pricing Plans
The Service offers a free tier with limited functionality and paid subscriptions: Basic, PRO, and ELITE.
Current prices and conditions are indicated on the Pricing page.
6.2. Payment Methods
Subscription payment is made through:
• Telegram Stars (in Telegram Mini App)
• Bank cards and other payment methods available on the website
6.3. Auto-Renewal
Subscriptions automatically renew at the end of the paid period if not canceled before the renewal date.
Auto-renewal cancellation is performed in Account settings or through the payment platform.
6.4. Refunds
Refunds are possible within 14 days of payment, provided the User has not used paid features.

7. AI Coach and Medical Disclaimer
IMPORTANT WARNING:
The AI Coach and other Service features are provided for informational purposes only and do not replace professional medical advice.
Consult with a physician before starting any workouts or changing your diet.
The Administration is not responsible for the consequences of using AI Coach recommendations.
The User is solely responsible for their health and safety.
8. User Content
By uploading photos, workout data, or other content to the Service, the User grants the Administration a non-exclusive license to use this content for:
• Providing Service features
• Improving AI algorithms (in anonymized form)
• Analysis and statistics
The User guarantees that they have all rights to the uploaded content and do not violate third-party rights.
9. Prohibited Actions
When using the Service, it is prohibited to:
• Upload illegal, harmful, or offensive content
• Violate the rights of other users
• Distribute spam or advertising
• Attempt to gain unauthorized access to systems
• Use the Service for fraud or illegal activities
• Create multiple accounts to bypass restrictions
10. Termination of Use
The Administration reserves the right to suspend or delete a User's Account without prior notice in case of:
• Violation of the terms of this Agreement
• Non-payment of subscription
• Inactivity for more than 2 years
• At the request of government authorities
The User may delete their Account at any time through the application settings.
11. Limitation of Liability
The Service is provided "as is" without any warranties.
The Administration is not responsible for:
• Service interruptions or technical failures
• Loss of data or content
• Results of using the AI Coach
• Actions of third parties
• Indirect or incidental damages
The Administration's maximum liability is limited to the amount paid by the User for the subscription during the last 3 months.
12. Changes to Terms
The Administration reserves the right to change the terms of this Agreement at any time.
Users will be notified of changes through the Service or by email.
Continued use of the Service after changes means acceptance of the new terms.
13. Applicable Law
This Agreement is governed by the laws of the Russian Federation.
All disputes are resolved through negotiations. If no agreement is reached — through the court at the Administration's location.
